Trade Customer Terms

Draft for legal review before launch. These terms are intended for business customers such as mobility dealers, manufacturers, importers, repairers, care organisations, auction businesses and online sellers.

1. Account approval

Trade account approval is at Transportability's discretion. We may request company details, billing information and references. Credit terms apply only where expressly agreed.

2. Orders and recurring work

Collections may be requested by email, telephone, booking portal or other agreed method. Transportability may require confirmation of equipment, route, access and collection requirements before acceptance.

3. Charges and invoices

Charges are based on the agreed tariff, quotation or booking. Additional waiting, redelivery, storage or materially changed requirements may be charged where agreed or reasonably required. Invoices are payable by the agreed due date.

4. Late payment

For qualifying commercial debts, statutory late-payment interest and fixed compensation may be available under applicable legislation unless the contract provides an alternative lawful arrangement. Transportability may suspend credit services where invoices are overdue.

5. Equipment

The trade customer warrants that it has authority to consign the equipment and has disclosed relevant defects, modifications, battery information, dimensions and weight. Unsafe or unsuitable equipment may be refused.

6. Collection and delivery

The trade customer is responsible for accurate collection/delivery addresses, site contacts and access information. Proof of collection/delivery may be electronic. The customer should inspect equipment at delivery and notify Transportability of visible issues as soon as reasonably possible.

7. Claims and liability

Transportability will exercise reasonable care and skill. Any business-to-business liability limitation must be interpreted subject to applicable law and reasonableness requirements. Nothing excludes liability that cannot lawfully be excluded or restricted.

8. Storage and abandoned equipment

Equipment not collected or deliverable because of customer circumstances may incur reasonable storage costs. If equipment remains uncollected after reasonable written notice, Transportability may take lawful steps to deal with it and recover reasonable costs.

9. Subcontracting

Transportability may use appropriately insured subcontractors where required, while remaining responsible for the contractual service subject to the agreed terms and applicable law.

10. Termination

Either party may terminate an ongoing trade arrangement in accordance with any agreed notice period. Transportability may suspend or terminate immediately for serious safety concerns, unlawful instructions, insolvency or material non-payment, subject to applicable law.
