Mobility Marketplace Seller & Buyer Terms
Draft for legal review before launch. These terms describe the intended operation of the Transportability marketplace. They do not exclude or restrict any liability or statutory right that cannot lawfully be excluded or restricted.
1. Transportability's role
Transportability Ltd operates the marketplace and advertising platform. Transportability is not the seller of equipment listed by third-party sellers and does not become a party to the contract of sale between a seller and buyer.
2. Contract of sale
Any contract for the purchase of a scooter, powered wheelchair or other equipment advertised through the marketplace is solely between the seller and the buyer. The seller is responsible for the equipment, its description, condition, title and any representations made about it. The buyer is responsible for deciding whether to purchase and for carrying out appropriate enquiries and checks.
3. Disputes, losses and liability for the sale
Any dispute, claim, refund request, complaint, loss or other disagreement arising from or connected with the sale of equipment is between the seller and the buyer. Transportability is not responsible for resolving the underlying sale dispute and, to the fullest extent permitted by law, accepts no responsibility or liability for losses arising from the seller's or buyer's acts, omissions, representations, condition of equipment, title to equipment, payment arrangements, failure to complete a sale, or any other matter relating to the sale itself.
This does not exclude or restrict any liability or statutory right that the law does not permit Transportability to exclude or restrict, including applicable consumer protections and liability for death or personal injury caused by negligence or fraud.
4. Advertisements
Sellers must provide accurate information and must not advertise equipment they are not entitled to sell. Sellers must disclose known material faults, relevant battery information, significant modifications and other information reasonably needed by a prospective buyer. Transportability may moderate, reject, suspend or remove an advert but moderation is not an inspection, warranty, certification or guarantee of the equipment.
5. Buyer enquiries
Buyer enquiries may be forwarded to the seller without publishing the seller's direct email address on the showroom. Transportability does not negotiate the sale price or terms unless expressly agreed as a separate service.
6. Listing fee and publication
The current base listing fee is £20 + VAT for a 30-day listing, subject to the price displayed when the seller submits the advert. Payment is processed through Stripe. Paid adverts enter moderation before publication where moderation is enabled.
7. Seller management
A private management link may be supplied to the seller so the seller can mark an advert sold or withdraw it. The seller must keep that link confidential.
8. Transportability transport services
If a buyer or seller separately books Transportability to collect or deliver equipment, that movement is a separate transport contract governed by the Transport Terms and applicable booking policy. A marketplace listing does not automatically include transport.
9. Prohibited content
Listings must not contain unlawful, fraudulent, unsafe or misleading content, or equipment that Transportability has reasonably identified as unsuitable for the marketplace. Transportability may remove content or suspend accounts where appropriate.
10. Governing law
These terms are intended to be governed by the law applicable to the relevant UK jurisdiction, subject to mandatory consumer protections and jurisdictional rights.
